A defendant shall be punished by imprisonment for six months.
except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Punishment of the crime
The Defendant is the representative of Gangwon-gun C Limited Partnership Co., Ltd., and the said Company was permitted to engage in development activities with respect to the size of the F,367 square meters of Gangwon-gun, Gangwon-do, which is 2,367 square meters of the size of the F, 367 square meters, when engaging in development activities using rocks generated at the site of the tunnel construction as fine aggregate.
1. Permission for the alteration of development activities shall be obtained in order to expand sites for earth and rocks in violation of the National Land Planning and Utilization Act;
Nevertheless, from May 2013 to November 201, 2013, the Defendant laid down earth and rocks generated from the said tunnel construction without obtaining permission to alter development activities on the size of 5,567 square meters in Gangseo-gun G, H, I, J, K, K, L, M, N, andO.
2. Permission for conversion of a mountainous district shall be obtained for conversion of a mountainous district for cutting earth and stones in a mountainous district violating the Management of Mountainous Districts Act;
Nevertheless, the Defendant converted the use of mountainous districts to use mountainous districts in a manner of piling up soil and stone generated from the above tunnel construction without obtaining permission for conversion of mountainous district with respect to the total area of 3,097 square meters in Pyeongtaek-gun, Sejong, P, Q, R, and N forest in the time and time stated in paragraph (1).
3. Permission for temporary use of farmland for any other purpose, such as piling up soil and rocks on farmland in violation of the Farmland Act;
Nevertheless, the Defendant temporarily used farmland for another purpose without obtaining permission for temporary use of farmland for the farmland area of 754 square meters in Pyeongtaek-gun, Seowon-gun, Gangwon-do, the date and time stated in paragraph (1).
4. No person who violates the State Property Act shall use or take profits from State property without complying with procedures and methods prescribed by Acts;
Nevertheless, with regard to the sum of the land owned by the state, the Defendant is required to approve the use of state property in relation to the total area of 2,908 square meters of land owned by the Gangwon-do, Gangwon-do, G, H, K, L, andO in the lump sum.
