A. The Plaintiff, as an electric sales agent under the Electric Utility Act, concluded an electric utility contract with 2,50kW with the entire contract power upon the Defendant’s application for electric utility use and supplied the power. The Defendant agreed to comply with the terms and conditions of the Plaintiff’s electric utility supply under the said electric utility contract. (2) On October 28, 2012, the Defendant terminated part of the previous contract power to the Plaintiff and changed it to 1,280kW (Evidence 1), but the entire contract power to 1,280kW to the Plaintiff (Evidence 1), and the entire contract power to 980kW [Attachment 1], and the customer contract power to the joint use customer by dividing it into “300kW (general use power by contract type).” The Plaintiff received the Defendant’s application for change and received the rate of the electric utility fee from the Defendant.

(3) On October 14, 2013, the Defendant sent to the Plaintiff an official document stating “An application for the termination of measuring instruments” under the title “application for the termination of measuring instruments.” (A evidence 2) The contract power of the said measuring instrument was 180kmW. (4) On October 14, 2013, the Plaintiff included 1,280kmW, which was terminated upon the Defendant’s application, into the representative customer contract power, and changed the Defendant’s contract power to “representative customer contract power 1,160kW, 120kW, 120kW, and 120kW power” (hereinafter “instant modification contract”). The Plaintiff supplied the same at the rate of 160k for the previous client’s use of the measuring instruments (hereinafter “the previous contract”).

B. The Plaintiff’s self-audit conducted a comprehensive audit from November 7, 2016 to November 24, 2016. The Plaintiff’s headquarters in the Gwangju Southern District Headquarters is the Defendant’s representative customer.
