Punishment of the crime
Defendant
A is the captain of E (197 tons, two-line vessel, and 17 boarding vessel) who is the fishing vessel of the Chinese tindo shipment, and the captain of the defendant B is the captain of F (197 tons, two-line vessel, and 16 boarding vessel) who is the fishing vessel of the Chinese tindo shipment.
E and F have obtained permission from the Minister of Maritime Affairs and Fisheries for conducting bareboat fishing activities in the exclusive economic zone of the Republic of Korea.
A Chinese fishing vessel which has obtained permission for conducting fishery activities in an exclusive economic zone of the Republic of Korea shall comply with the permitted conditions, and shall notify the National Federation of Korea of the entry into the exclusive economic zone of the Republic of Korea not later than 12 hours prior to the entry into the exclusive economic zone, and a fishing vessel which has obtained permission for fishing operations shall cover the fishing vessel with a double or more brupted lus when it loads the relevant vessel,
Defendants entered the exclusive economic zone of the Republic of Korea at around 02:0 on February 14, 2014 (round February 14, 2014, around 01:00 Chinese time) and did not dint or cover the e-mail (round 14:20 on February 14, 2014, around 15:20 on February 14, 2014) in the territorial economic zone of the Republic of Korea (round 50.5 nautical miles in the exclusive economic zone of the Republic of Korea) located in the Republic of Korea, New-nam Islands, the exclusive economic zone of the Republic of Korea ( around 14:20 on February 14, 2014, about 50.9 nautical miles in the territorial economic zone of the Republic of Korea), even though they loaded water in E and F, and did not cover it.
