A. On April 16, 2014, after the accident of sinking of the Sewol ferry on the sea near the Chonam-gun, Jindo-gun, the Special Act on Finding the Truth of the April 16 Sewol Ferry Disaster and Building a Safe Society (hereinafter “Special Act”) was enacted on November 19, 2014, and came into force on January 1, 2015.

Article 3 of the Special Act provides that the Special Investigation Committee on the April 16 Sewol Ferry Disaster (hereinafter referred to as the “Committee”) shall be established to ascertain the truth of the April 16 Sewol ferry disaster, improve a system related to the construction of a safe society, and inspect measures to support victims. B. Pursuant to Article 6 of the Special Act for the formation of the Committee, two members shall be elected on November 27, 2014; the Korean Bar Association shall appoint two members on November 28, 2014; the Chief Justice shall appoint two members on December 9, 2014; the National Assembly shall elect ten members on December 29, 2014; and the President, on February 17, 2015, notified the President of the term of office of the above members on February 17, 2015 to the standing members of the Committee or non-standing members of the Committee on March 15, 2015, respectively.

On March 9, 2015, the Committee held the first meeting and elected the Chairperson.

Enforcement Decree of the Special Act on the Quota of Employees and Organization of Committee(see Article 15 of the Special Act) was enacted and implemented on May 11, 2015.

On May 27, 2015, the Committee publicly announced the employment of employees and granted a letter of appointment to the selected employees on July 27, 2015, and the Committee's budget was decided by the State Council on August 4, 2015 and allocated it to the Committee.

C. On July 27, 2015, the Plaintiffs are public officials in extraordinary civil service (see Article 19(2) of the Special Act) who are appointed to the Committee (attached Form 1) and have been employed as an employee as a public official in each class listed in the Public Officials Remuneration List, and are in charge of administrative support offices, fact-finding stations, and safety society under the Committee;
