1. The defendant shall pay to the plaintiff KRW 47,837,042 and KRW 36,772,659 among them, per annum from July 1, 2004 to the day of full payment.

Reasons

1. On August 16, 2002, the Plaintiff leased KRW 50 million to the Defendant at the maturity of August 16, 2003, at the rate of 9.5% per annum, and at the rate of 20.5% per annum. Only KRW 12,227,341, which is a part of the principal from July 28, 2004 to February 23, 2007, the Plaintiff was paid from the Defendant. The Plaintiff claimed damages for delay on July 1, 2004 based on the agreed rate of delay damages from July 1, 2004 (Article 208(3)2 of the Civil Procedure Act).
