The plaintiff's claim is dismissed.
Litigation costs shall be borne by the plaintiff.
1. According to Article 58(1)2 of the Military Personnel Management Act, the person having authority over disciplinary measures against officers, warrant officers, noncommissioned officers, and enlisted personnel other than general-grade officers is the head of an association (including the head of an association), fleet commander, the head of an aircraft group, and the head of an equivalent or higher military unit or agency. The Plaintiff demanded the disciplinary committee to make a disciplinary resolution on the ground of the following grounds for the disciplinary action. Based on the result, on May 8, 2019, the person having authority over disciplinary measures for salary reduction for one month (hereinafter “instant disposition”).
Article 56 subparag. 2 and 3 of the Military Personnel Management Act provides, “When a soldier who has an authority to take disciplinary action under Article 58 commits an act impairing his/her dignity or violates his/her official duties, he/she shall request the disciplinary committee under Article 58-2 to decide on disciplinary action and take disciplinary action according to the result of such disciplinary action.”
1. Breach of duty to maintain dignity (hereinafter referred to as "grounds for disciplinary action";
