1. Basic facts
A. The Plaintiff is the owner of the real estate indicated in the attachment No. 1 (hereinafter “instant land”).
B. C. After purchasing E’s land from the Plaintiff and installing a oil tank (hereinafter “oil tank”). At the time, some of the oil pipelines connected to the oil tank at the time were laid underground on the ground of the attached Form 2, 8, 9, 10, 11, and 8, connected in order to each point of the instant land, the part of the oil pipelines connected to the said oil tank was laid underground on the ground of 30 square meters (hereinafter “instant oil pipeline part”).
At present, a stone fence is installed on the ground that connects each point of 1, 2, 3, 4, 5, 6, 7, 8, 9, and 1 of the annexed drawings 2 among the land of this case, and part 63 square meters in part 1, 2, 3, 4, 5, 6, 7, 8, and 9 of the annexed drawings 1, 2, 3, 4, 6, 8, and 9 of the annexed drawings 2 are attached to the line that connects each point of 1, 2, 3, 4, 5, 6, 7, 8, and 9.
On the other hand, the dispute part of this case is higher than the other part of the land of this case (which is currently being used as the road of this case), and there is a retaining wall to prevent soil erosion from the boundary part of the dispute of this case, i.e., the boundary part of the dispute part of this case, which is at the lower part of the said steel materials fence.
