1. On July 15, 1974, with respect to the registration of transfer of ownership in the name of F on May 25, 1995, the registration of transfer of ownership in the name of G [the ground for recognition] pursuant to the former Act on Special Measures for the Registration, etc. of Ownership of Real Estate (Act No. 4502, Nov. 30, 1992; invalidation], the registration of transfer of ownership in the name of H on August 18, 1999; the registration of transfer of ownership in the name of the Defendant (the ground for registration of ownership in the name of H on August 18, 1999; the ground for registration of ownership transfer in the name of H on August 17, 199; the ground for registration of ownership transfer in the name of H on March 13, 199; and the ownership transfer in the name of H on March 24, 200; and the ownership transfer registration in the name of H on March 29, 2004>
On June 1, 1960 with respect to the portion of 450/853 square meters, E-si, E-si, 2820 square meters, the registration of ownership transfer in the name of J on June 1, 1960, the registration of ownership transfer in the name of F on July 15, 1974, the registration of ownership transfer in the name of F on June 21, 1995 with respect to the portion of F 403/853 square meters on June 21, 1995, the registration of ownership transfer in the name of G on October 15, 1981 (the reason for the sale as of October 15, 1992, Act No. 4502, Nov. 30, 1992), the registration of ownership transfer in the name of H on November 26, 1998 (the sale and purchase on November 12, 199), and the reason for ownership transfer in the name of H on March 24, 20094.
2. 이 사건 소의 적법여부에 관한 판단 주장요지 : ▷원고는, 이 사건 토지가 L 14세손 M 후손 중 만 25세 이상 된 자로서 주로 순천시 일대에 거주하는 자들로 구성된 원고의 소유인데, 별지 기재와 같이 부동산 명의를 신탁하여 관리하고 있고, 이 사건 소장 송달로 명의신탁을 해지하므로 피고는 원고에게 이 사건 부동산에 관한 소유권이전등기절차를 이행할 의무가 있다고 주장한다.
