In the event that the Defendants did not pay the above fine, the Defendants did not pay the fine.

1. Defendant A

(a) Any person who violates the Food Sanitation Act shall report to the Commissioner of the Korea Food and Drug Administration, a Special Self-Governing Province Governor or the head of a Si/Gun

그럼에도 피고인은 2016. 4.경부터 2016. 7. 7.까지 서울 중랑구 F에 있는 G 앞 구유지에서 관할구청장에게 신고하지 아니하고 포장마차에 조리대, 가스레인지, 가스통 등 조리시설을 갖추고 그곳을 찾는 불특정 다수의 손님들에게 하루 평균 약 10만원 상당의 떡볶이 등을 조리ㆍ판매하여 일반음식점 영업을 하였다.

(b) No person in violation of the Public Property and Commodity Management Act shall use or profit from public property unless he complies with the procedures and methods prescribed by Acts;

Nevertheless, the Defendant did not follow the procedure and method of maintaining the previous G, which is a public property, at the time and place mentioned in the above paragraph (a).

2. Defendant B

(a) Any person who violates the Food Sanitation Act shall report to the Commissioner of the Korea Food and Drug Administration, a Special Self-Governing Province Governor or the head of a Si/Gun

Nevertheless, from March 2016 to July 7, 2016, the Defendant prepared and sold 10,000 won per day to unspecified customers with cooking facilities, such as cooking rooms, gas bags, and gas pipes, without reporting to the head of the competent authority in the G maintenance in front of G in Jung-gu Seoul Metropolitan Government, and prepared and sold 20,000 won per day to general restaurants.

(b) No person in violation of the Public Property and Commodity Management Act shall use or profit from public property unless he complies with the procedures and methods prescribed by Acts;

Nevertheless, the Defendant did not follow the procedure and method of maintaining the previous G, which is a public property, at the time and place mentioned in the above paragraph (a).

3. Defendant C

(a) Any person who violates the Food Sanitation Act shall be engaged in food service business;
