1. The defendant shall pay 400,000,000 won to the plaintiff and 12% per annum from September 27, 2020 to the day of complete payment.

3. The Plaintiff seeking payment of damages for delay from October 16, 2019 for the agreed amount of KRW 400 million. However, there is no evidence to prove that the due date for the agreed amount was fixed, which is a debt with no fixed deadline. Since the Defendant is liable for delay from the time of receiving the request for performance, the part claiming damages for delay from October 16, 2019 to September 26, 2020, which is the delivery date of the copy of the complaint of this case, is dismissed.
