Purport of claim and appeal

1. The reasoning for the court’s explanation of this case is as stated in the reasoning of the judgment of the first instance except for the dismissal of the judgment of the first instance as stipulated in the following paragraph (2). Thus, it is acceptable to accept this as it is in accordance with the main sentence of Article 420 of the Civil Procedure Act.
2. In the end of the second part of the second part, “The terms and conditions applicable to this case’s contract shall be prescribed as “when a person dies due to a disaster as specified in attached Table 2 (Disaster Classification Table) that occurs on the ordinary day” as the requirement for the payment of the insurance proceeds for death in the ordinary day, and the term “accident” shall be prescribed as “accidents which occur on the ordinary day (Provided, That where a person who has a disease or physical nature factor and has caused a minor external factor or aggravated its symptoms, a minor external factor shall not be considered as an contingent external accident)”. The following of the 10th part “4 April 2014” shall be added respectively.
Part 3, Part 4 “A.” added to the following:
"An accident" under the insurance contract of this case means all the causes of death caused by external factors, not due to physical defects, i.e., disease or physical physical factors, etc. of the insured (see Supreme Court Decision 98Da28114, Oct. 13, 1998) and "However, where a person who has a disease or physical characteristics and caused a disease or aggravated external factors, or whose symptoms worsen further, the minor external factors do not constitute contingent external accidents" are excluded from contingent external factors, even if a minor external factors are directly and indirectly caused by the disease or physical properties of the insured, even if they were processed, they are excluded from "an accident" under the insurance contract. Thus, if the processed external factors are deemed to have been serious or directly caused by the death, the disease or physical properties of the deceased.
