Punishment of the crime
Defendant
A is a person who is on board the fleet C(64 tons) of Busan Port, and the defendant B is the representative of the private business chain E and the owner of the ship who operates the ship transport business with the headquarters of D. D. 502 of the Busan City/Do.
No one shall discharge pollutants from a ship into the sea.
1. Defendant A was under supply and demand in a container, which was kept in a container to reuse 18 liter-A oil discharged through a container in the engine room of C, and from around 08:00 on September 22, 2013, the Defendant was in the process of shesheing C’s atmosphere into the outside fuel oil supply and demand side and sheing a container at a small-sized ship wharf that is located in Ulsan-gu, Ulsan-gu, Ulsan-gu, the head of which was located.
In such cases, the duty of care to prevent leakage on the sea is required to be ensured that the loading capacity of the fuel oil tank (6,600 liters) is confirmed.
Nevertheless, at around 08:26 September 2, 2013, the Defendant supplied and supplied 18 liters fuel oil tanks to C, and did not verify whether the fuel oil tank is equipped with, caused the contamination of the surrounding sea ( approximately 30m x 10m) by discharging about 15 liters into the sea through supply and demand changes.
Accordingly, the Defendant discharged oil, which is a pollutant from a ship.
2. Defendant A, an employee of the above Defendant B, committed the above violation in relation to the above Defendant’s business.
