Punishment of the crime
피고인은 주식회사 C와 부산 해운대구 D에 있는 C 건물 컨벤션홀(1층, 2층, 3층) 및 다목적홀(2층, 3층)에서 행사ㆍ회의 일정을 고려한 예식 행사ㆍ피로연 케이터링 영업을 할 수 있는 임대차 계약을 체결하여 예식장 영업을 해오던 중 행사ㆍ회의 일정으로 인하여 예식장 장소를 확보하기가 점점 어렵게 되자, 2008. 6. 1.경 주식회사 C와 C 건물 지하 1층 퀸즈홀에 관한 임대차 계약을 체결하였다.
A person who intends to change the use of a building from the "Neighborhood Living Facility Group" to the "cultural and assembly facility group" shall obtain permission from the competent authority.
그럼에도 불구하고 피고인은 부산시청의 허가 없이 2009. 1. 말경부터 2012. 12. 초경까지 도시지역에 해당하는 위 C 건물 지하 1층 퀸즈홀 2,435.48㎡ 중 729㎡를 문화 및 집회시설인 예식장으로 인테리어 시설을 한 뒤 예식장 영업을 하였다.

As to the Defendant’s assertion of the provisional payment order under Article 334(1) of the Criminal Procedure Act, a justifiable reason exists to believe that the use of the provisional payment order has been changed to a wedding hall in light of the following: (a) the Defendant believed to have promised to allow the Defendant to operate a wedding hall in C, a lessor of the instant building; (b) changed the purpose of use to neighborhood living facilities; and (c) there was a fact that C was understanding that the case was exceptionally tugboated.
