피고인은 2014. 8. 23. 22:00경 인천 남동구 B아파트) C마트 앞 노상에서, 피해자 D(여, 51세 이 걸어가는 것을 보고 피해자에게 “야, 돼지야, 푹신푹신하겠다”라는 등 막말을 하고, 이를 피하는 피해자를 쫓아가서 계속하여 피해자에게 “물 많이 나오냐, 돼지야” 등의 막말을 계속하여 이에 피해자가 항의한다는 이유로 소주병이 든 비닐봉투를 들어 피해자 얼굴을 향하여 휘두르는 등 피해자에게 폭행을 가하였다.
