A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
On September 15, 2017, the Defendant had been sentenced to one year of imprisonment for a crime of fraud at the Suwon Fagwon, and the judgment became final and conclusive on September 23, 2017.
Punishment of the crime
1. On April 1, 2017, the Defendant: (a) indicated the terms of a contract that he/she leases “No. 128 of Gangdong-gu Seoul Metropolitan Government Type C with a deposit amount of KRW 2,70,000,000 to March 14, 2019; (b) stated the name of Gangdong-gu Seoul Metropolitan Government E, 508 Dong1028; (c) written “F” in the resident number column; (d) the file stating “G” in the name of Gangdong-gu, Seoul Metropolitan Government 128; and (d) the receipt thereof; and (e) the content of the deposit amount of Gangdong-gu 1,28,000,000 in the name of Gangdong-gu 1,50,000,000,000,000 won; and (e) the balance of the deposit amount of KRW 1,285,00,000,000 in the name of Gangdong-gu 3,000.

Accordingly, for the purpose of exercising the right and duty, the Defendant set up one commercial lease contract (monthly rent) and one receipt, respectively, in the name of H, which is a private document on the proof of the right and duty and fact.
2. On April 4, 2017, the Defendant: (a) submitted to K a forged commercial lease agreement (monthly rent) and one receipt to K, who was aware of the forgery at the Gangdong-gu Seoul Metropolitan Government I building and the notary public J office No. 22 of the fourth floor; and (b) submitted as if he were a genuine document, one copy of the forged commercial lease agreement and one receipt.
3. On the ground that the Defendant borrowed money from the victim K at the temporary location under paragraph (2) and received money from the victim K, the Defendant’s “D” store in Gangdong-gu Seoul Metropolitan Government.
