1. 특수협박 피고인은 2015. 10. 13. 18:03경 서울 은평구 은평로 111에 있는 이마트 은평점 지하 4층 주차장에서, 차량 통행로에 본인 소유의 C 투싼차량을 정차한 채 뒷트렁크에 유모차를 싣고 있던 중 피해자 D(여, 46세)이 운행하던 차량 통행에 방해가 되어 경적을 1회 울리자 화를 참지 못하고 “기다리라고, 씨발년아, 애기 타고 있는데 개 같은 년, 어디서 씨발, 빵빵거리고 뒤질라고, 씨부랄년”이라고 하면서 피해차량으로 걸어와 잠겨진 피해차량의 운전석 문을 당기며 “어휴, 이 씨발년을 죽여버릴라 진짜”라고 욕을 하고, 다시 본인의 차량으로 돌아가 운전석 하단 수납함에 보관하고 있던 위험한 물건인 낚시용 칼(칼날길이 15cm, 총길이 29cm의 일명 ‘뼈칼’)을 꺼내들고 와 칼집에서 칼을 꺼낸 후 피해차량 운전석 창문을 치며 “내리라고, 씨발”이라고 욕을 하며 겁을 주었다.
