그럼에도 불구하고 피고인은 피해 회사인 주식회사 넥 슨 코리아가 운용하고 있는 ‘ 서든 어택’ 게임과 관련하여 C, D 등이 불법적으로 제작 또는 유포하는 ‘E (2017. 2. 경 ’F‘, ’G‘ 등으로 명칭 변경됨)’, ‘H’, ‘I’ 등의 악성 프로그램( 이른바 ‘ 게임 핵 프로그램’) 즉, 피해 회사가 제공하는 게임 클라이언트 데이터에 부정한 명령을 수행하는 코드를 주입하여 위 악성 프로그램 사용자로 하여금 게임 상대방의 캐릭터를 자동 조준할 수 있게 하는 ‘ 오토에 임’ 기능, 총을 격발할 때 반동이 되지 않게 하는 ‘에 임 고정’ 기능, 장애물을 투시하여 게임 상대방의 캐릭터를 볼 수 있게 하는 ‘ 전 신월 핵’ 기능, 상대방 캐릭터 주변을 겨냥해도 상대방 캐릭터를 맞출 수 있게 하는 ‘ 바디 샷’ 기능, 상대방 캐릭터의 신체 일부를 겨냥해도 머리를 맞출 수 있게 하는 ‘ 제 패’ 기능 등을 사용할 수 있게 함으로써, 그렇지 않은 게임 이용자들보다 유리하게 게임을 할 수 있게 하는 프로그램을 불특정 다수의 위 게임 이용자들에게 판매하기로 마음먹었다.
