1. The judgment of the court of first instance is modified as follows.
on May 25, 2017, the Defendant promulgated the Changwon to the Plaintiff.
1. Details of disposition;
A. The Plaintiff is the operator of a public housing development project for Changwon-si, Changwon-si, Changwon-si, Changwon-si, Gapo-dong, 473,857 square meters in accordance with the Special Act on Public Housing.
B. Under Article 6(1) of the Act on Promotion of Installation of Waste Disposal Facilities and Assistance, etc. to Their Environs (hereinafter “Waste Facilities Promotion Act”), the Plaintiff paid to the Defendant an amount equivalent to the cost of installing waste disposal facilities to treat wastes generated in the said project
(hereinafter referred to as “waste charges”). (c)
On May 25, 2017, pursuant to Article 6 of the Waste Facility Promotion Act and the Ordinance on the Establishment and Operation of Funds (hereinafter “instant Ordinance”), the Defendant issued a disposition to the Plaintiff to allow KRW 3,704,461,00 of the waste charges calculated as follows to pay in three installments, in accordance with the following Ordinance on the Collection of Expenses for Waste Disposal Facilities in Changwon-si and the Establishment and Operation
(‘이 사건 처분’). 시설 설치비 부지매입비 설치 규모 - 폐기물발생량 × 월 최대변동계수 - 3.459톤/일 × 1.29 = 4.462톤/일 시설부지면적 = (시설부지 40㎡ × 4.462톤 관리동 330㎡ 세차동 330㎡) ÷ 건폐율 40% = 2,096.2㎡ 총면적 2,096.2㎡ 주민편익시설(시설면적의 10%) 209.6㎡ = 2,305.8㎡ ∴ 부지매입금액: 총 부지면적 × 택지조성원가 = 2,305.8㎡ × 404,974원/㎡ = 933,789천원 설치비 - 4.462톤 × 340백만원/톤 = 1,517,080천원 ◎ 소각시설 설치 비용 ◎ 음식물처리시설 설치 비용 시설 설치비 부지매입비 설치 규모 - 폐기물발생량 × 규모지수 - 2.586톤/일 × 1.2 = 3.103톤/일 시설부지면적 = (시설부지 40㎡ × 2.586톤 관리동 330㎡ 세차동 330㎡) ÷ 건폐율 40% = 1,908.6㎡ 총면적 1,908.6㎡ 주민편익시설(시설면적의 10%) 190.8㎡ = 2,099.4㎡ ∴ 부지매입금액: 총 부지면적 × 택지조성원가 = 2,099.4㎡ × 404,974원/㎡ = 850,202천원 설치비 - 3.103톤 × 130백만원/톤 = 403,390천원 (단위 : 천원) 구분 폐기물처리시설 설치 비용...
