피고인은 2013. 3. 12. 23:00경 서울 중구 B 앞 도로에서 피고인이 C를 폭행하였다는 신고를 받고 출동한 경찰관 피해자 D(30세)이 피고인을 제지하자 "손자뻘도 안되는 개자식아! 개 씨발놈아! 끝발도 없는 새끼가 좆같이 구네, 개새끼, 니가 경찰이면 다냐"라며 약 10여분 동안 욕설을 하고 계속하여 주먹으로 피해자의 오른쪽 얼굴과 복부를 각 1회 때려 피해자의 범죄 진압과 예방에 관한 정당한 공무집행을 방해하였다.
