1. The Defendant: (a) KRW 50 million for each of the Plaintiffs, as well as 5% per annum from October 1, 2015 to October 28, 2016; and (b).
Comprehensively taking account of the respective descriptions and the purport of Gap evidence 1-1 and 2-2, the plaintiffs may recognize the fact that the plaintiffs set forth and lent the defendant under the joint and several guarantee of D, the amount of KRW 60 million on July 6, 2015, and KRW 40 million on August 3, 2015 as of September 30, 2015, respectively.
Therefore, the defendant is obligated to pay to each of the plaintiffs 50 million won [(60 million won) x 1/2 x 5% per annum as stipulated in the Civil Act from October 1, 2015 to October 28, 2016, which is the service date of the original copy of the payment order in this case, and 15% per annum as stipulated in the Act on Special Cases concerning Expedition, etc. of Legal Proceedings from the following day to the day of full payment.
