The amount of consolation money shall be determined as KRW 30 million in consideration of all the circumstances, such as the marriage period of the Plaintiff and C, the period and degree of the commission of the unlawful act committed by the Defendant and C, the circumstances leading up to the Plaintiff’s becoming aware of such unlawful act, and the influence of the said unlawful act on the marital life

Therefore, as for consolation money for mental suffering from the above tort, the defendant is obligated to pay to the plaintiff 30 million won and damages for delay calculated by the rate of 5% per annum as stipulated in the Civil Act from April 21, 2017 to June 22, 2017, which is obviously a day after the delivery date of a copy of the complaint in this case, as sought by the plaintiff, and 15% per annum as stipulated in the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings from the next day to the day of complete payment.

Therefore, the plaintiff's claim of this case is accepted within the scope of the above recognition, and the remaining claim is dismissed as it is without merit. It is so decided as per Disposition.
