1. 업무방해 피고인은 2019. 11. 19. 11:54경 서울 도봉구 B에 있는 피해자 C이 운영하는 ‘D’이라는 상호의 가게에 방문하여 짬뽕밥 1인분, 소주 5병 등을 시켜 먹은 후 같은 날 14:00경 자신의 체크카드를 이용하여 결제를 하려고 하였으나 잔액 부족으로 결제가 되지 않자, 마침 위 가게에 방문하였던 성명불상의 거래처 사장에게 자신의 여자친구인 E을 불러달라고 하였다.
