1. Basic facts
A. In relation to Plaintiff A’s land ownership, Plaintiff A is the owner of 132,397 square meters of forest land in Gwangju City, and Plaintiff B is the owner of 32,209 square meters of forest land in Gwangju City.
(hereinafter referred to as “each of the above lands Nos. 1 and 2”
(1) On February 26, 1985, the Defendant completed the registration of creation of superficies with respect to the land of this case on the ground of the contract to establish superficies as of February 26, 1985, No. 3470, the Suwon District Court, Sungnam-Support Registry, which received on December 24, 1984: The Defendant’s superficies: The purpose: The period of superficies: the period of the construction and ownership of steel towers and transmission lines: the special agreement for the period of existence of steel towers and transmission lines: the total land rent of KRW 616,074 shall not be paid at one time, and the rent shall not be increased during the duration of superficies. The land of this case includes rent following the construction and ownership of transmission lines at the space on the land of this case. C) From the date of each of the instant superficies contract, the Defendant installed a special high pressure processing transmission line on the land and the airspace above each of the instant land and manages it up to the present day. The size of the steel site and the space above each of the instant land is as indicated in the attached Tables 2 and 3. D.
