1. 1. 업무방해 피고인은 2014. 3. 10. 12:30경 부산 기장군 I에 있는 피해자 J가 운영하는 K 식당에서 피해자로부터 소주 1병을 주문하여 마시다가 옆 테이블에 있던 불상의 손님에게 아무런 이유 없이 "야 씨발 놈아 개새끼야 외상값도 얼마 안되는데, 참 좆같네“라고 말하면서 의자를 들었다가 놓는 시늉을 하는 등 약 20분에 걸쳐 소란을 피워 위력으로써 피해자의 식당영업업무를 방해하였다.

2. 모욕 피고인은 전항과 같은 일시 및 장소에서 위 1항으로 인해 112신고를 받고 출동한 경찰관인 피해자 L과 M에게 위 식당 주인 부부 등이 있는 자리에서 "야 이 씹할 새끼야. 너거 짭새들 다 죽었다. 야 폴리스 정신병자가. 똘괘이가. 나는 칼쪽이다. 너거 정리되겠다."라고 큰소리로 욕설하는 등 공연히 피해자들을 모욕하였다.
