The meaning of "taking equipment related to control affairs" under Article 244(1) of the Public Official Election Act
공직선거법 제244조 제1항 소정의 ‘단속사무와 관련한 장비’라 함은 선거부정감시단원 등이 불법 선거운동의 단속사무에 사용하기 위하여 소지하고 있는 물건을 뜻하고, 그 장비를 ‘탈취’한다고 함은 유형력을 행사하여 그 소지자의 의사에 반하여 그 장비를 자신의 지배 아래로 옮기는 행위를 뜻하며, 단속사무와 관련한 장비임을 알면서 이를 탈취하면 위 조항 소정의 죄가 성립하는 것이고, 단속사무와 관련한 장비의 탈취 당시 그 소지자가 단속업무를 수행 중인 상태에 있거나 탈취자에게 단속사무를 방해할 의사가 있어야만 위 죄가 성립하는 것은 아니다.

공직선거법 제244조 제1항 소정의 ‘단속사무와 관련한 장비’라 함은 선거부정감시단원 등이 불법 선거운동의 단속사무에 사용하기 위하여 소지하고 있는 물건을 뜻하고, 그 장비를 ‘탈취’한다고 함은 유형력을 행사하여 그 소지자의 의사에 반하여 그 장비를 자신의 지배 아래로 옮기는 행위를 뜻하며, 단속사무와 관련한 장비임을 알면서 이를 탈취하면 위 조항 소정의 죄가 성립하는 것이고, 단속사무와 관련한 장비의 탈취 당시 그 소지자가 단속업무를 수행 중인 상태에 있거나 탈취자에게 단속사무를 방해할 의사가 있어야만 위 죄가 성립하는 것은 아니라고 할 것이다.
In full view of the adopted evidence, the court below acknowledged the fact that the non-indicted was carrying the control of the defendant with the knowledge that the defendant was carrying out activities concerning the control affairs, such as securing evidence related to the election as a person from the election commission, and recognized the fact that the defendant was carrying the control of the defendant by exercising force, and decided that the defendant's act was a violation of Article 244 (1) of the Public Official Election Act. In light of the above legal principles and records, the above decision of the court below is just and acceptable, and there is no error of law such as misunderstanding of facts against the rules of evidence or misunderstanding of legal principles as to the violation of Article 244 (1) of the Public Official Election Act
Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
