Reasons

1. Details of the disposition;

A. On February 5, 2002, the Plaintiff was appointed as Local Fire Captain in Busan Metropolitan City, and served at B Center from January 15, 2017 to October 23, 2018.

The Plaintiff’s act of verbal abuse, intimidation, or intimidation, such as abusive speech, intimidation, and teacher, during one-hour period from August 28, 2018, to around 17:5 to 19:00, the Plaintiff constitutes grounds for disciplinary action pursuant to Article 9 of the Decree on Punishment of Fire Officials and Article 4 of the Rules on Disciplinary Measures against Fire Officials (Demand for Disciplinary Measures, etc.) and Article 63 of the Fire Officials (Demand for Disciplinary Action, etc.) that constitutes grounds for disciplinary action against a violation of any provision of Article 56 (Duty of Good Faith), Article 57 (Duty of Uniforms), and Article 63 (Duty to Maintain Dignity) of the State Public Officials Act and Article 4 (Demand for Disciplinary Action against Offenders) of the Rules on Disciplinary Measures, etc. against Fire Officials.

B. On September 27, 2018, the head of the Central 119 Rescue Center requested a resolution of heavy disciplinary action against the Plaintiff (hereinafter “instant disciplinary action request”) by the Fire Officers Disciplinary Committee of the Central 119 Rescue Center (hereinafter “the instant disciplinary committee”) for the following grounds for disciplinary action.

Reviewing the reasons for the request for disciplinary action against the suspect:

가. 원고의 경우 모든 공무원은 법령을 준수하며 성실히 직무를 수행하여야 하고, 공무원은 직무를 수행할 때 소속 상관의 직무상 명령에 복종하여야 하며, 직무의 내외를 불문하고 그 품위가 손상되는 행위를 하여서는 아니된다라고 규정되어 있음에도 소방위 원고는 2018. 8. 28. (화) 17:55~19:00까지 약 1시간에 걸쳐 B센터 내 지휘차 안, 차고 앞, 사무실 등에서 직속 상급자인 팀장 소방경 C에게 지휘차 안에서 “개새끼야”, “씨발새끼야”, 사무실에서는 귓속말로 “개새끼야 니가 제정신이냐”는 욕설과 센터장에게 보고하려 이동 중인 팀장을 1층과 2층 사이 계산에서 목을 잡아 벽 쪽으로...
