피고인은 2015. 7. 22. 23:54경 의왕시 모락로 삼거리에서 C이 운전하는 D 소나타 승용차 보닛 위에 아무런 이유 없이 올라가는 등 도로에서 소란 행위를 한다는 112 신고를 받고 출동한 E지구대 소속 경위 F, 경위 G이 피고인에게 경범죄처벌법위반으로 통고처분을 하려고 하자 G에게 “짭새 개새끼야”라고 욕설을 하며 손으로 때리려고 하고, 옆에 있던 F이 피고인을 말리자 F의 왼쪽 허벅지와 음낭 부위를 각 1회 걷어찬 뒤 순찰차량의 운전석 문을 걷어차 F의 손목 부위에 부딪히게 하여 약 2주간의 치료가 필요한 팔 부위 타박상을 가하고, 이를 말리던 G의 멱살을 잡고 목을 조르는 등 폭행하였다.
