A. The primary Defendant, as a member of the B-Do Council (C constituency), performed parliamentary activities as the chairperson of the B-Do Council Committee on Economic Science and Technology from July 1, 2014 to June 30, 2016, and was in charge of the examination and determination of the Do budget, including B-do economic office, approval of the settlement of accounts, and inspection and investigation of the administrative affairs of B-do.

On July 2015, the Defendant issued a request from the Secretary-General of D Organizations (hereinafter “D”) to the effect that “D intends to carry on the job EXPO-related business in D” by telephone, and that “D will request F City public officials to receive special adjustment grants from F Do, so that D would carry on the business in F.”

Accordingly, at around July 2015, the Defendant requested that F City Planning and Budget Director H, etc. of F City Planning and Budget Division H, and “F City apply for special adjustment grants for job EXPO-related business in B, and receive subsidies, so that D can receive such subsidies.”

On July 15, 2015, the F market economy division applied for the special adjustment subsidy of KRW 400 million to F City Planning and Budget. The F City Planning and Budget applied for the special adjustment subsidy of KRW 400 million to B, and B notified that the special adjustment subsidy of KRW 400 million should be allocated to F City around July 31, 2015.

Around July 2015, the time when the above decision was made by B, the Defendant called B around the end of July 2015 to E and demanded “B to provide budget support for the I Games at F City, but D would not be able to provide budget support,” and E accepted this.

After that, around December 9, 2015, after the completion of the above job exhibition business, E is an account in the name of M, a company run by K director L, an incorporated association, through the J of D Enterprise Support Headquarters, from around December 9, 2015.
