1. The Defendant’s KRW 30,471,185 as well as the Plaintiff’s annual rate from February 22, 2014 to December 10, 2015.

Reasons

1. Basic facts

A. Defendant Corporation is a local government public corporation established on August 6, 2007 pursuant to Articles 76(1), 76(2), and 49(2) of the Local Public Enterprises Act and the Seoul Special Metropolitan City Ordinance on the Establishment and Operation of the Facilities Management Corporation with the aim of contributing to the improvement of residents’ living convenience and welfare by efficiently managing public facilities in Seoul Special Metropolitan City.

B. On August 19, 2010, the Plaintiff was appointed as the president of Defendant Corporation by the head of Seoul Special Metropolitan City B (hereinafter “head of B”) from August 19, 2010 to August 18, 2013.

The plaintiff entered into a performance-based contract and annual salary contract with the head of B/L on the same day (hereinafter referred to as the "management-based contract of this case") and worked as the president of the defendant Corporation from that time. The main contents of the management-based contract of this case and annual salary contract of this case are as follows

In accordance with Article 58-2 of the Local Public Enterprises Act and Article 56-2 of the Enforcement Decree of the same Act, the purpose of this contract is to set the standards for the management of the board of directors by concluding a management performance contract between the head of B and the chief of the board of directors on all matters, such as management objectives to be achieved during the term of office of the board of directors of the facility management corporation, the authority and responsibility of the board of directors, and remuneration including performance-based bonuses,

Article 3 (Period of Contract) (1) The term of this contract shall be from August 19, 2010 to August 18, 2013.

Article 6 (Management Objectives) (1) The management goals to be achieved by the chief director during his/her term of office shall be as specified in attached Table 2.

Article 7 (Report on Management Performance) The chairperson shall prepare a report on the management performance of the management objectives for the relevant year and submit it to the head of the Gu by May of the following year.

Article 8 (Evaluation of Performance Results of President Management Objectives) (1) The evaluation of the performance results of the president's management goals (hereinafter referred to as the "evaluation of performance results") shall be conducted by the head of B and the management performance report.
