1. The defendant,

A. Plaintiff A, 44,283,30 won, 30,681,640 won to Plaintiff C, 36,218,840 won to Plaintiff D, and Plaintiff E.

Reasons

1. Facts of recognition;

A. The defendant is a school foundation that operates L University (hereinafter "Defendant University"), and the plaintiffs are professors working in the defendant University.

B. Article 53-2(3) of the Private School Act provides that the faculty members of a college educational institution may be appointed on such contractual terms as the period of service, salary, conditions of service, achievements, and performance agreements, as prescribed by the articles of incorporation. In such cases, the relevant provisions applicable to the faculty members of a national or public university shall apply to the period of service. According to the defendant’s articles of incorporation, Article 45 of the defendant’s articles of incorporation provides that “The remuneration of teachers shall be determined separately by the resolution of the board of directors in accordance with the qualifications, career, difficulty of duties, and degree of responsibility.” Article 2 of the above articles of incorporation provides that “The remuneration of teachers and staff shall be enacted and implemented in accordance with the above articles of incorporation, and Article 2 of the Regulations on the Remuneration of Public Officials, except as otherwise provided for in this provision, may apply mutatis mutandis to the remuneration of teachers and staff of a university. In the event of the implementation of the annual salary system, detailed matters concerning their operation shall be determined separately by the president.”

(2) The term "annual salary" means the total annual remuneration, excluding other allowances.

(3) Monthly amount of an annual salary means a month calculated by dividing the annual salary by 13 months.
