모욕
The prosecution of this case is dismissed.
1. The summary of the facts charged is a person who constructed a house C in Sungnam-si, Sungnam-si, as the representative director of the corporation B, and the complainant D and E are married couples and live in the above house.
2017. 7. 4. 경 위 고소인 주택에서 고소인들과 고소 인의 자녀, 공인 중개사 부부가 함께 있는 자리에서 고소인들에게 “ 야 이 시발 놈 아 너 몇 살 먹었어, 이 개새끼야 너 몇 살이야 시발 놈이 콱 죽여 버릴라 이 개새끼야” 라며 욕설을 하여 공연히 고소인들을 모욕하였다.
2. Determination and conclusion
(a) Applicable legal provisions: Articles 311 and 40 of the Criminal Act;
(b) Offenses subject to prosecution upon complaint: Article 312 (1) of the Criminal Act;
C. The complainant’s agent’s withdrawal of the complaint on May 11, 2018 shall be submitted to this court.
(d) Judgment dismissing public prosecution: Article 327 subparagraph 5 of the Criminal Procedure Act;
