However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

1. 피해자 C, 피해자 D에 대한 업무방해 피고인은 2015. 2. 5. 20:00경 충주시 E 소재 ‘F 충주점’에서 햄버거를 주문하던 중 종업원인 피해자 C로부터 단품 메뉴를 주문하는 것인지, 세트 메뉴를 주문하는 것인지 질문을 받자 갑자기, “단품이 뭔지 몰라 씨발년아, 유식한 척 하지마!”라고 큰 소리로 말하며 그곳 주방 내로 들어가려고 하고, 그곳 매니저인 피해자 D가 이를 제지하자 “뚱뚱한 년이, 손님이 왕인데 씨발년아, 내가 너 감방 보낸다, 못생긴 년이!”라고 큰 소리를 치며 피해자 D을 때리려고 하는 등 약 7분 동안 소리를 지르며 매장 내를 돌아다니면서 소란을 피워 다른 손님들로 하여금 주문하려다 되돌아 나가게 하는 등 위력으로써 피해자들의 매장 운영 및 관리 등에 관한 업무를 방해하였다.
