1. Basic facts
A. The Plaintiff is a company with the objective of building design, supervision of construction works, and consulting services related to construction. The Defendant is an association established for the purpose of implementing a housing redevelopment improvement project (hereinafter “instant rearrangement project”) in the Seocho-gu E Board in Changwon-si, Seoul Special Metropolitan City.
B. The Plaintiff and the instant promotion committee entering into a design service contract between the Plaintiff and the instant promotion committee
On November 3, 2006, the Plaintiff publicly announced the selection of the designer of the instant rearrangement project and resolved to select the Plaintiff as the designer of the instant rearrangement project by holding an extraordinary general meeting on November 25, 2006. (2) On February 2, 2007, the Plaintiff and the Plaintiff Co., Ltd. (hereinafter “G”) entered into a design service contract for the instant rearrangement project (hereinafter “instant 1 service contract”) with the instant promotion committee, and the main contents are as follows.
(1) Under the following contract, “A” and “B” refer to the Plaintiff and G. Article 3 (Scope of Services) (1) B perform the following duties concerning the Housing Redevelopment Improvement Project implemented by A:
1. Preparation of design documents necessary for formulating a project plan and applying for designating a rearrangement zone;
2. Consultation on and support for technical matters concerning formulation of a rearrangement plan and designation of a rearrangement zone;
3. Preparation of design documents necessary for an application for authorization for project implementation; 12. Preparation of project implementation plans for the construction, structure, electricity, facilities, soil mounds, civil engineering, landscaping, and landscape landscaping; 14. Preparation of design documents for the design drawings; 18. Consultation on design changes and preparation of the revised design documents; 19. Preparation of construction reports; completion inspection; and other necessary matters;
