피고인은 2017. 8. 13. 13:20 경 수원시 팔달구 B에 있는 C 교회 2 층에서 피해자 D과 다른 교인이 다투는 것을 보고 피해자에게 그만 하고 가라고 하였는데 피해자가 “ 너나 그만둬 너가 뭔 데 그래 ”라고 반말을 하였다는 이유로, E, F 등 교인 10 여 명이 지켜보는 가운데 피해자에게 “ 썅 년”, “ 개년”, “ 씨 부 랄 년” “ 여우 같은 년” 이라고 욕설을 하여 공연히 피해자를 모욕하였다.
