이에 피고인은, ① 2015. 3. 31. 20:27 경 안동시 D E 대학교 기숙사 내에서 불특정 다수가 접근할 수 있는 위 B의 페이스 북 게시판에 자신의 닉네임으로 접속한 다음 피해자를 지칭하며 “ 저 여자가 오빠 스토킹 계속 했는데 이젠 쫌 불쌍하기까지 ” 라는 댓 글을 게시하고, ② 2015. 4. 2. 09:40 경 같은 장소에서 같은 게시판에 자신의 닉네임으로 접속한 다음 피해자를 지칭하며 “ 근데 쟤 분노조절 장애 이런 거 있어 조심 ㅠㅠ” 이라는 댓 글을 게시하고, ③ 2015. 4. 5. 11:55 경 같은 장소에서 같은 게시판에 자신의 닉네임으로 접속한 다음 피해자를 지칭하며 “ 얼굴이 몰려 있어 그런가 할 말 못할 말 못 가리는 듯” 이라는 댓 글을 게시하고, ④ 위 다 항과 같은 날 같은 장소에서 같은 게시판에 기숙사 룸메이트인 F의 닉네임으로 접속한 다음 피해자를 조롱하는 얼굴 그림을 첨부하여 “ 저 여자 이래 생김”, “ 진짜 얼굴 몰려 있음, 밑에 ㄲ ㄲ 하마 상" 이라는 댓 글을 게시하는 등 피해자를 공연히 모욕하였다.
