On August 30, 2019, around 20:22, the Defendant assaulted, without any reason, the victim’s left hand, while drunk in the first floor of the building in Ansan-si, Seoul.

2. The offense of assault can not be prosecuted against the victim’s express intent (Article 260(3) of the Criminal Act). Since the victim expressed his/her intention not to prosecute the defendant after instituting the prosecution, the prosecution of this case is dismissed in accordance with Article 327 subparag. 6 of the Criminal Procedure Act.
