The defendant's appeal is dismissed.
Reasons
1. The summary of the grounds for appeal (mental and physical weak) was in a state of mental and physical weakness, such as having shocked, due to depression at the time of committing the instant crime.
2. In light of the records, the Defendant committed the instant crime under the lack of the ability to discern things or make decisions at the time of committing the instant crime.
Therefore, the defendant's assertion is without merit.
3. In conclusion, the defendant's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the grounds that the defendant's appeal is without merit. It is so decided as per Disposition.
