1. The defendant A shall be punished by imprisonment with prison labor for one year and by imprisonment with prison labor for eight months;

2.Provided, That this judgment shall become final and conclusive, respectively.

Reasons

Punishment of the crime

Defendant

B is a lessee of H apartment house 315 Dong 1402, who is a rental house located in G in Kimpo-si, and the lessee of the rental house, in principle, may not sublet the rental house to any other person: Provided, That the lessee of the rental house may move the house to another Si/Gun/Gu that has been located at the administrative district of the Si/Gun/Gu that is located at the present time due to reasons such as work, occupation, or treatment of disease, etc., and sublet the rental business operator’s consent. Although Defendant B failed to meet the above sublet requirements, he sublet the above apartment house 1402 to I around January 10, 2015, and Defendant A was a person operating the K Authorized Brokerage Office in J in Kimpo-si, who was aware that the above sublet requirements were not met.

Defendants: (a) around April 22, 2016, Defendant B transferred the right of lease 1402 of the above apartment building to L; (b) requested L I to surrender to L; (c) filed a criminal complaint and civil lawsuit against the Defendants; and (d) he forged the documents as if he had already met the above sub-lease requirements and submitted them to the investigation agency.

1. Violation of Acts on rental housing;

(a) A lessee of a rental house under Defendant B shall not sublet the rental house, and no person shall arrange such sublet;

Around January 10, 2015, the Defendant: (a) at the above public brokerage office around January 10, 2015, the lessee of the above apartment, a rental house, failed to meet the above sub-lease requirements; (b) however, he/she set the said apartment unit 1402 term from February 6, 2015 to February 5, 2017.

(b) A lessee of a rental house of the defendant A shall not sublet the rental house, and no person shall arrange such sublet.

On January 10, 2015, the Defendant: (a) at the above authorized brokerage office operated by himself; (b) B, a lessee of the above apartment unit 1402, a rental house, is the above sub-lease requirement.
