The defendant shall be innocent.
Reasons
1. On July 12, 1995, at around 23:24 on July 12, 1995, the driver B, who was the defendant, loaded export machinery, clothing, etc. on the above vehicle at the 20.4km Seoul Highway, and operated the vehicle loaded in excess of 11.8 tons out of the load storage.

Thus, the above facts charged constitute a crime, and thus, the defendant is acquitted under the former part of Article 325 of the Criminal Procedure Act.
