Reasons

1. Facts of recognition;

A. The status of the parties is an organization consisting of occupants or users (total of 888 households) in privatecheon City, and the defendant is a sectional owner who acquired the sectional ownership of the above apartment No. 101 and 301 (hereinafter “the apartment of this case”) on January 27, 2010.

(b) Article 1 (Purpose) of the Housing Act, the Enforcement Decree thereof, and the management rules of collective housing shall aim to protect occupants and users and to maintain order in the residential life by prescribing matters necessary for the management or use of collective housing pursuant to Article 44(2) of the Housing Act and Article 57(1) of the Enforcement Decree of the same Act;

Article 3 (Definition of Terms)

1. The term "occupant" means the owner of multi-family housing, or his/her spouse, lineal ascendants or descendants representing such owner;

2. The term "user" means a person, other than an occupant, who leases and uses multi-family housing;

3. The term "occupants, etc." means occupants and users;

6. The term "managing body" means the head of a management office and a housing management operator who manages multi-family housing, etc.;

Provided, That it means a project operator until occupants, etc. select the management entity.

(1) Residents, etc. shall place the council of occupants' representatives under Article 50 of the Decree in the multi-family housing complex to achieve the purpose under Article 1, and the name of the council of occupants' representatives in the A apartment complex.

Article 13 (Duties of Occupants, etc.) (1) In addition to the matters prescribed by the Housing Act and subordinate statutes, occupants, etc. shall have the following duties for the maintenance of order of communal living, the improvement of residential life, and the maintenance

1. Obligations to comply with relevant regulations;

7. Other duties to comply with for the maintenance and management of multi-family housing.
