Punishment of the crime
[Criminal Records] On July 9, 2015, the Defendant was sentenced to imprisonment with labor for a violation of the Act on the Promotion of Information and Communications Network Utilization and Information Protection, Etc. (Defamation) at the Seoul Eastern District Court on August 9, 201, and the said judgment became final and conclusive on January 28, 2016.
1. [2016 Highest 1871] The Defendant is a person who publishes “B(C)” online newspapers related to the reading, engages in activities as an editor and reporter.
A. On January 14, 2015, the Defendant committed the crime of January 14, 2015, at the Defendant’s house located in Gwangjin-gu Seoul Special Metropolitan City (Seoul), that the victim graduated from the F High School and the graduate school of the G University, and that the victim obtained a master’s degree and doctor’s degree at the G High School and the G University, which is located in Canada, on the B bulletin board of the above B B for the purpose of slandering the victim despite having obtained a master’s degree and doctor’s degree, “H” as the title of “H” without high school graduation, and it was confirmed that the Y and the Y E company of the E company that entered the Canadian University was not a regular high school.
Accordingly, the Defendant, through the information and communication network, destroyed the reputation of the victim by exposing false facts openly.
B. On January 16, 2015, the Defendant committed the crime of January 16, 2015, in relation to the victim E at the above Defendant’s office, published a letter stating that “The victim graduated from the F High School and the graduate school of the G University, and obtained a master’s degree and doctor’s degree at the NA college located in Canada, the Defendant shall deprive the victim of his/her graduation by re-verification of the educational background of E who graduated from J without graduating a regular high school and by re-verification of the educational background of E who graduated from J without graduating, and thereby deprive him/her of his/her graduation.”
Accordingly, the Defendant, through the information and communication network, destroyed the reputation of the victim by exposing false facts openly.
