The judgment below

In light of the records, the court below is justified in maintaining the judgment of the court of first instance that acquitted the defendant on the ground that the facts charged in this case constitute a case where there is no proof of facts constituting the crime. Contrary to the allegations in the grounds of appeal, the court below did not properly conduct the necessary deliberation and did not err by misapprehending the law of logic and experience and exceeding the bounds of the principle of free evaluation of evidence, or by misapprehending the legal principles on the criminal intent of the fraud and deception

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
