1. Facts of recognition;
A. The Plaintiff, with the trade name of “B”, has been engaged in domestic and foreign transportation brokerage business, and has received commission from the Defendant since March 2012, on behalf of the Defendant, such as transportation and customs clearance of the goods imported by the Defendant.
B. On December 7, 2012, the Plaintiff: (a) performed the transportation and customs clearance of the Defendant’s imported goods (i.e., trade goods ALUININUBES, five total packing number, five total packing number, and 267kg) imported through Asian and Aeronautical (i.e., the Plaintiff’s commission of transportation and customs clearance; (b) KRW 1,590,360 in total; (c) KRW 1,436,08 in total; (d) KRW 154,272 in lieu of the bonded transportation commission (i.e., customs clearance).
그 중 ① 통관 등 대행수수료는 ㉠ 항공운임(Air Freight Charge) 781,744원, ㉡ EXW 조건(EX-Works, 공장인도조건, 즉 매도인의 화물인도가 수출업자의 공장이나 창고 등에서 이루어지고, 수입업자가 화물을 인수한 이후의 수출통관 등 모든 위험과 비용을 부담하는 운송조건) 비용 557,382원, ㉢ 착지불 수수료(charge collection fee) 66,962원, ㉣ 핸들링 차지(handling charge, 취급수수료) 30,000원 등으로 이루어져 합계 1,436,088원(= 781,744원 557,382원 66,962원 30,000원)이 된다.
그 중 ② 보세운송료 대납금(부가가치세 포함)은 ㉠ 보세운송료 99,000원, ㉡ 보세운송 수수료 11,000원, ㉢ 보관료 및 작업료 14,572원, ㉣ 통관수수료 29,700원 등으로 이루어져 합계 154,272원(= 99,000원 11,000원 14,572원 29,700원)이 된다.
C. On August 23, 2013, the Plaintiff sent a content-certified mail demanding the Defendant to pay the commission for customs clearance, etc. on December 17, 2012.
