The request for retrial is dismissed.
The litigation costs for retrial shall be borne by the plaintiff.
Reasons
Examining the grounds for the instant judgment subject to a retrial, there is no ground for retrial, such as when there is a defect in granting a legal representation right, powers of attorney, or authority necessary for a legal act by a representative, as alleged by the Plaintiff (Plaintiffs) in the said judgment, when there is an omission of judgment on important matters affecting the judgment.
Therefore, the retrial of this case is dismissed, and the costs of the retrial are assessed against the losing party. It is so decided as per Disposition by the assent of all participating Justices.
