However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

From February 2018 to July 2019, the Defendant is an insurance solicitor at the Han River Branch of the Victim C Co., Ltd in Gwanak-gu in Seoul Special Metropolitan City from February 2018 to July 2019.

On August 3, 2018, the Defendant, at the above Han River Branch Office, concluded an insurance contract with the victim company for the "E", which is 150,000 monthly payment premium, as a policyholder D paid insurance premium at his own expense and maintained an insurance contract normally.

However, in fact, when concluding a new insurance contract, the Defendant did not intend or have ability to pay the insurance premium and maintain the insurance contract in a normal way because it was intended to pay and invalidate part of the insurance premium of the said insurance contract by taking advantage of the fact that the Defendant would receive the insurance sales commission from the victim company.

As above, the Defendant deceptioned the victim company and received KRW 830,60,06 from the victim company as the insurance sales commission on September 21, 2018, and received KRW 830,606 from the victim company as well as the amount of KRW 79,70,00 from April 5, 2018 to June 14, 2019, as described in the list of crimes in the attached Table of Crimes, deceiving the victim company as if the policyholders were to pay insurance premiums at their own expense and maintain the normal insurance contract, and then deceiving the victim company and its employees were paid KRW 72,732,928 from the victim company as the insurance sales commission from May 25, 2018 to July 25, 2019.

Accordingly, the defendant was given property by deceiving the victim company.
