[Criminal Justice] On February 3, 2016, Defendant B sentenced Defendant B to imprisonment for a crime of fraud at the Seoul Western District Court on February 3, 2016, and completed the execution of the sentence in Seoul Southern Prison on January 20, 2018.

【Criminal Facts】

1. On Nov. 1, 2019, Defendant A received a proposal from a name-free winner (hereinafter “C”), who operates an online horse game site, and installed a horse game program in the “EPC Game site” located in Sungnam-si, Sungnam-si, in a computer, induced many and unspecified persons to visit the said PC game site by publicizing the said PC game site, and where the visiting customer made profits from the betting amount while engaging in the horse game, Defendant A conspired with 40% and C with 60%, respectively.

From early November 2019 to April 2, 2020, the Defendant established the said PPC game room in accordance with the above public offering, and set up the said PC game room in the said PC game room in order for customers visiting the said PC game room to immediately use the PC game program “G”, which was not rated by the online game site (F). Through public relations, the Defendant allowed customers visiting the said game to access the said game. On the other hand, upon receiving certain money from customers, the Defendant visited the call center known by C to the game center to charge the game money corresponding to the said PC, and made customers pay the remaining game money in cash by converting it into one won per 1 game money.

Accordingly, the Defendant, in collusion with the above “C”, provided a game program that has not been rated, and used the game money exchange business, which is the result obtained through the use of game products.

2. Defendant B is rated as described in paragraph (1) at the PC game room from November 2019 to April 2, 2020 by Defendant B.
