1. The defendant shall be the plaintiff.

Reasons

1. Where the Plaintiff had the Defendant use the building as stated in the Disposition No. 1 for 16 years, the Plaintiff demanded the Defendant to withdraw the permission for use and deliver the building prior to about 3 years, but the Defendant did not comply with it up to the present day, thus seeking delivery of the above building and return of unjust enrichment for the rent party (Articles 208(3)2 and 150(3) of the Civil Procedure Act).
