For reasons indicated in its reasoning, the lower court: (a) the Defendant’s entry into the safety zone directly caused the instant accident;

The judgment of the first instance court that dismissed the instant prosecution was affirmed.

The judgment below

In light of the records, the above determination by the court below is just, and contrary to the allegations in the grounds of appeal, there were no errors in the misapprehension of legal principles as to "violation of instructions indicating safety signs" under Article 3 (2) 1 of the Act on Special Cases concerning the Settlement of Traffic Accidents.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
