A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Punishment of the crime
Despite the fact that the Defendant is not a narcotics handler, the Defendant treated narcotics as follows:
1. On January 20, 2016, the Defendant received approximately 0.24 g of Melopon from D, a Melopon (one philopon; hereinafter “philopon”), which is a local mental medicine, from Gangseo-gu Busan, Busan, and received Melopon from C without compensation.
2. On January 20, 2016, the Defendant administered narcotics, etc. by inserting approximately 0.03ghon in Busan Jin-gu, Busan, and approximately 0.03ghon in a single-use injection machine, dilution with water, and injection with arms.
3. On January 22, 2016, the Defendant administered narcotics, etc. by inserting approximately 0.03g of philophones into a disposable injection machine, dilution with water, and then injecting them into arms.
4. On January 24, 2016, the Defendant administered narcotics, etc. by inserting approximately 0.03g of philophones into a disposable injection machine, dilution with water, and then injecting them into arms.
5. On January 27, 2016, the Defendant administered narcotics, etc. by inserting approximately 0.03g of philophones into a disposable injection machine, dilution with water, and then injecting them into arms.
6. On January 30, 2016, the Defendant administered narcotics, etc. by inserting approximately 0.03g of philophones into a disposable injection machine, dilution with water, and then injecting them into arms.
7. On February 2, 2016, the Defendant administered narcotics by inserting approximately 0.03g of philophones into a single-use injection machine, dilution with water, and then injecting them into arms.
8. On February 5, 2016, the Defendant administered narcotics by inserting approximately 0.03g of philophones into a single-use injection machine, dilution with water, and then injecting them into arms.
9. On February 11, 2016, the Defendant injected narcotics, etc. by inserting approximately 0.03g of philophones into a single-use injection machine, dilution with water at the above places, and then injecting them into arms.
10. On February 14, 2016, the Defendant received from D the delivery of narcotics, etc., free of charge, from D in Gangseo-gu Busan Metropolitan City, for a 0.03gh from D.
