1. The Defendant’s KRW 79,163,060 for the Plaintiff and KRW 5% per annum from October 22, 2014 to December 10, 2014.

From March 1, 1996 to October 21, 2014, the Plaintiff served as an employee at Waljar Memorial Hospital located in the Geum-gu, Busan in his operation of the Defendant, and the Defendant did not pay the Plaintiff KRW 10,676,80 for July 10, 2014; KRW 10,637,80 for August 2014; and KRW 10,926,20 for September 1, 2014; KRW 46,922,260 for retirement allowances; KRW 79,163,060 for total amount of KRW 10,67,80 for July 2014; and KRW 10,926,20 for September 2014.
According to the above facts, the defendant is obligated to pay to the plaintiff 79,163,060 won in total of the retirement allowances payable to the plaintiff and delay damages calculated at the rate of 5% per annum prescribed by the Civil Act from October 22, 2014 to December 10, 2014, the service date of the original copy of the payment order in this case, and 20% per annum prescribed by the Act on Special Cases concerning Expedition, etc. of Legal Proceedings from the next day to the day of full payment.
2. The conclusion is that the plaintiff's claim of this case is reasonable, and it is so decided as per Disposition.
